Schultz files lawsuit
We just learned that attorneys for former Sonics owner Howard Schultz today filed the expected lawsuit against the current Oklahoma-based ownership group. Schultz is claiming the Oklahoma owners did not act in good faith when trying to secure a new arena deal to replace KeyArena in Seattle, and he is attempting to rescind the July 2006 sale in order to get the team back.
Meanwhile, by now you’ve all heard that Slade Gorton is now open to settlement talks with the Sonics and the NBA as long as the league guarantees the city of Seattle a replacement team.
One last thing, Tulsa Mayor Kathy Taylor had some nice things to say about Oklahoma City getting approval from NBA owners to become home to the Sonics. Taylor said what’s good for OKC is good for Tulsa.
“It really puts Oklahoma on a national map, and that’s what’s important. And it continues to grow the economy of Oklahoma City, which helps Tulsa,” Taylor said. “We are the two most significant contributors to the state economy. Anything that we can do to help Oklahoma City’s economy expand is good for Tulsa.”

This lawsuit is just silly, there is nothing in the agreement that required them to own the team for any defined amount of time.
The reason that Shultz sold the team was because he knew Seattle wouldn’t take his threat of moving the team seriously so he sold to someone where the threat was real…..a “sweet flip” would have meant they got an arena built and made good on the agreement.
They would have been the best thing Seattle could have hoped for if they would have got an arena built and sold the team back to local owners.
The team would have been worth alot more with a new arena and they would have made a nice profit.
That is the definition of a “sweet flip”.
Take that one step further and Bennett would have saved the Hornets from financial ruin after Katrina, he would have saved the Seattle market for the NBA and there is no doubt in my mind that OKC would have gotten a team with Bennett as the owner.

are you still saying this, and, saying that, and, the story is this, and, the story is that???? what we have in 1st district court is the story. a REAL story. all you come up with is PERSONAL thoughts, while, on the other hand, there are 3 current pending items of litigation that clay-boy must address. 1 out of the 3 wins, and, you sorry little thieves will be laid out on the carpet in front of the whole nation!! now, if you could phillip, come up with anything more concrete, or, do some actual research into what you post, we in turn, might listen to you a little bit. but, rambling on, and, on, and, on about we are losing the sonics over an arena we will not provide. you are VERY correct there!! if you ever owned a business (hotdog carts dont count, although, my roomate owns one here!), and, that business owned aprtments that rented out on a LEASE basis, and, said tenants of these apartments didnt want to honor the lease on thier apartments, and, wnated to up and move, what would you do poor phillip?? here, let me answer that for you…….SUE THE CRAP OUT OF SAID TENANT!!! look in any civil court proceedings in any national newspaper including yours, and, you will see tons of these lawsuits, and, WE ARE NO DIFFERENT!! Schultz coming through with actually filing the lawsuit, and the first of many more emails coming out brings new life to the situation.
The weasle Sten must be regretting teaming up with such a moron. Who in their right mind sends repeated emails about fraudulent intentions? What an absolute moron! How do people with zero common sense get to be so wealthy?

i’m starting to understand why okc folk have no shame in the fact they stole a team under these circumstances—it’s a cultural thing. the political process would’ve eventually worked, we have the money and the will, it was simply about letting the process unfold organically. we’re not that ‘desperate fat girl’ and we don’t need to succumb to thug tactics—holding a city under duress in order to get what you want only works in situations of desperation and inferiority(see mortgaging your future, i.e., diverting children’s education money to wealthy nba owners).
in okc it’s okay to smack your wife up a little and make her feel bad about herself because if she leaves and gets a divorce, she’s going to hell. in seattle, we don’t believe in hell, walking on water, or the toothfairy, so our women are allowed to think rationally, make money, and have hobby’s other than cooking or cleaning. the problem is, they don’t always listen when you raise your voice (or your fist).

i can understand that. it probably does get old having to live in it, the last thing you want is to continually be reminded by a bunch of seattle elitists.

I’m sure there are other emails. I just don’t think that there are any that are going to make any difference. The latest one isn’t.
It doesn’t suprise me at all that he would have been thinking at the time that they could have sold the Sonics back to locals for a nice profit if they could get an arena built. I also wouldn’t be suprised to find out that Stern promised him another team if he could get it done.
Shultz’s suit contends that Bennett had no intention of getting an arena built when he bought the team. I’ve seen no evidence of that. If Shultz had a more conclusive or damning email proving it, they would have mentioned it in the suit to strengthen their position.
Did you see the Seattle Times poll where over 60% blame Shultz for Seattle losing the Sonics? Thats why Shultz filed the suit. It’s all for show.

Here’s what Lester Munson thinks about that, in his Q&A with ESPN:
“The lawsuit is more than a public relations stunt. The allegations against Bennett and his group are serious and seem to indicate a fraud at the time of the sale. The chronology of the e-mails is compelling evidence that will allow Schultz to push Bennett and his group into a bad corner. If it were a PR stunt, both Schultz and Yarmuth would be holding press conferences and making dramatic statements. Neither would comment to ESPN.com beyond what is said in the lawsuit. The language of the suit is lean and spare. If anything, it understates the case. Their conduct and their lawsuit are clear indications they are serious about their allegations and their attempt to undo the sale.”

Yes, you too can take part in stealing another city’s team. 41 years of history. I know it’s not the everyday Oklahoma fans who are doing it. But to the ones that think it’s ok… hopefully you’ll never see this or any other team…. ever.
Guess what Philip. There are even more emails yet to be released. It’s rumored that we’ll have another tomorrow. Since Bennett gave his deposition today, I’d expect that it contradicts what he told under oath. This guy is dumber than I thought; he may end up in jail before this is all over.
DM, I know you’ve probably been swamped by all the coverage of the Sonics relocation, but would be interested to hear your take on an interesting circumstance of the BOG meeting. Suposedly, it was brought up during the consideration to allow the Sonics to move to OKC that the Sonics would have to move before the 2008-2009 NBA season or relocation approval would be invalidated and the Sonics would have to reapply next season. Apparently, it was the representative from the New Orleans Hornets that raised this issue with the BOG. What do you make of this?

it seems like if the sonics get tied up in litigation, the hornets might try to re-claim the ford center, doesn’t it? THAT would be hilarious if bennett got screwed by his own state. weird that no one is talking about that…
The “recomendation” for relocation is still out there but only if the situation doesn’t change. If Seattle has an arena package done and an ownership group that changes the whole thing.
On top of that move by Shinn the reports are that the owners worked Clay over hard. What should have taken an hour went on for almost 4 hours while he fought for his life. They may publicly say they will approve a future relocation request but the more they get embarrassed by Clay the less likely they will do anything for him.
As more and more facts come out about the fraud it is getting to be more likely that Clay is going to have to bail out pretty soon or risk losing everything. Not just the Sonics but his business could be destroyed if he stands trial for fraud.
If Stern really is his friend he will step in soon and put a stop to all this buy just finding a way to get OKC a different team.
