One question is this: Would UT & OU be willing to stay in the conference with equal revenue sharing with the other schools?

Another is whether or not enough schools in the Pac 12 would vote to allow the Texas & Oklahoma schools to join. What if Cal, Stanford and UCLA joined Colorado and voted them down?

Not sure anyone has been damaged yet as long as the Fox network contract remains. That is a totally different issue than refusing to sign a waiver of liabilty. The quote in this article is pure press spokesperson/office of communications dodging of an issue.

The SEC is asking for signed waivers by all nine schools. Why would a school waive their rights?
