		<description><![CDATA[First...we do not know any details as to Blackmon testing and results for alcohol....it seems being he was released shortly thereafter he was NOT drunk. It may be that he never even took a dring. 

As for DUI it is overstated.....the crime it seems would be that he, if he did drink, was that he was  underage. That is completely a different issue. How many people go to the Cowboy games and buy a beer and then drive home. They do not get a DUI if stopped unless there blood alcohol level is above limits.]]></description>

		<description><![CDATA[Vicki, in Texas, if you are under 21, they charge you with DUI even if you are within the legal limit for adults.  Since there was no breath or blood test done, they simply charged him as DUI based on their suspicions/observations.  Just like in the days before breathalyzers existed.  Field sobriety tests are joke, though, the police simply write up whatever &quot;boilerplate&quot; stuff they think is needed to get a person convicted.  I know that from personal experience when I was stopped many years ago, and never even got a ticket because the only thing I was charged with was DUI.  It didn&#039;t fly because I DID take the breath test and was way below the legal limit, and I felt totally sober.  But you should have read the police report, which had me falling down drunk! It would have been laughed out of court by the JUDGE, given my breathalyzer results, so I was never even charged!  You cannot trust the police on the reports they file at all.  It was a very &quot;sobering&quot; lesson for me, I had been SO-O-O naive about the police prior to that!  Just good people doing a tough job, right??  Wrong!  Call them for help at your own peril, they are more likely to harm than help you.]]></description>
